Panier Gifts Inc. (Panier, we or us) is committed to protecting the personal information of our customers using this website (Site). To that end, we offer this Privacy Policy to inform our Customers (referred to individually, or collectively, as you) of how we collect, protect, use, and disclose your personal information.

1. What is Personal Information? Personal information means information that can be used to identify, contact, or locate you and includes, among other things, your name, address, telephone number, email address, birth date, billing information (credit card number, expiration date, and billing address), occasion type (Mother’s Day, etc.), products purchased, and the gift and message recipient's name, address, telephone number, email address, and any other information you may provide us.

2. When Do We Collect Personal Information? Panier collects personal information from you when you voluntarily submit that information to Panier, for example: when you place an order; participate in one of our on-line sweepstakes, contests, or surveys; respond to an offer; or register for other individualized services.

3. What Non-Personally Identifiable Information do we collect? When visiting our Site, we may collect basic Non-Personally Identifiable Information about you, like your operating system, browser software, and IP (Internet Protocol) address that is collected to improve the services of the Site, for example, detecting problems with our server and administering our Site. We compile and analyze Non-Personally Identifiable Information on an aggregate basis.

4. How Do We Use Personal Information

a. Use of Your Information for our Internal Business Purposes. We do not sell, trade, or rent your personal information to third parties. Panier only uses the information you provide for the purposes for which it was provided, for example, to process your order; to respond to your inquiries; to insure proper delivery to gift recipients; or to contact you or send you information about your account. We may compile and analyze your personal information on both a personal and an aggregated basis so that we can measure relative customer interest in the various areas of our Site. We note again though, that any information collected is used for our own internal purposes to improve the content and navigation of our Site, to better understand your needs, and to improve the products, benefits, and services that Panier may offer to you.

b. Use of Your Information for Panier’s Direct Marketing. As noted above, we do not sell, trade, or rent personal information to third parties. When signing up for an account or placing an order, there may be an option to receive marketing notifications from Panier Gifts, Inc. This option will usually be in the form of a checkbox that requires your explicit action to check the box in order to “opt-in” to our marketing communications. Only if you affirmatively select this option, then we may use your personal information to contact you about products and services, special offers and upcoming promotions or events offered by Panier, our affiliates, or our marketing partners that we think may be of interest to you (direct marketing). Note that although our direct marketing may include offers or marketing materials from third parties, we do not disclose your personal information to these third parties. If you later decide that you no longer wish to receive direct marketing communications from Panier Gifts, Inc., you may opt out of such uses and/or disclosures by (a) checking the appropriate “Opt Out” box in any applicable email communication, or (b) sending an email to: info@paniergifts.com. Once you have opted out, your subsequent registration for our direct marketing services and promotions, or our sweepstakes and contests may void, temporarily or permanently, your prior elections to opt out of receiving direct marketing communications from Panier. Please consult the applicable rules of the promotion or service before participating.

c. Transfer of Personal Information to Third Party Goods and Services Providers. Panier employs third party vendors, service providers, and suppliers to perform various functions on our behalf, such as fulfilling orders, processing credit card payments, debt collection, removing repetitive information from customer lists, analyzing data, and hosting and maintaining databases. These organizations may have access to personal information to the extent needed to perform their functions, but they may not use it for other purposes, such as marketing their products and services to you or disclosing your information to third parties.

d. Mergers and Acquisitions. In the event of a merger, consolidation, or sale or transfer of all or substantially all of the assets or business of Panier Gifts Inc., one of the assets which would generally be transferred is the information we collect from our customers. However, the use of this information by any successor would still be governed by the terms of this Privacy Policy, as amended from time to time, including any amendment after such transaction, and you will continue to have the right to opt out of sharing your information with third parties. Similarly, we may also use and disclose your personal information to parties connected with the contemplated or actual financing, insuring, sale, assignment or other disposal of all or part of our business or assets, including for the purposes of determining whether to proceed or continue with such transaction or business relationship or fulfilling any records or other reporting requirements to such parties. We will require such parties to treat your personal information in accordance with this privacy policy and to use and disclose it only for the purposes for which it was collected.

e. Cooperation with Law Enforcement. From time to time, we may be required by law enforcement or judicial authorities to provide personal information to the appropriate governmental authorities. We will disclose personal information upon receipt of a court order or subpoena or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

5. How Do We Handle Information from Children? The Site is a general audience site and Panier has no intention of collecting personal information from individuals under the age of 18 (“children”). Where appropriate, we instruct children not to provide such information to us. If a parent becomes aware that a child has provided us with personal information, we ask that the parent or legal guardian of the child contact us by sending an e-mail to info@paniergifts.com or calling 877-888-8799 to request that this information be deleted from our records.

6. Use of Cookies/Clear GIFs. Cookies: Like many other commercial sites, our Sites utilize standard technologies called "cookies”. A cookie is a small data text file which a website stores on your computer's hard drive (if your web browser permits) that can later be retrieved by the issuing website in order to “remember” you. Cookies were designed to help a website recognize a user's browser as a previous visitor and thus save and remember any preferences that may have been set while the user was browsing the site. For example, Panier uses cookies to remember your e-mail address so that you will not have to re-enter this information each time you visit the Site. Panier Gifts, Inc. uses cookies for two independent purposes: (1) If you have an account with us and log into your account, a cookie is used to track the account you are logged into and provide you with the information specific to your account, or (2) If you do not have an account with us or have not yet logged into your account, cookies enable us to keep track of all of the items you have added to your shopping cart.

Clear GIFs: We currently do not use clear GIFs on our websites or in any advertisement. However, we reserve the right to use clear GIFs in the future, and prior to the utilization of clear GIFs this document will be updated accordingly to reflect any changes to this policy.

7. Links to Other Web Sites. Our Sites may contain links to other Web sites. Privacy policies on such linked sites may be different from our Privacy Policy. Panier is not responsible for the privacy practices and content of these third-party Web sites. You access such linked sites at your own risk. We urge you to follow safe Internet practices and to not supply Personal Information to these Web sites unless you have verified their security and privacy policies.

8. What Security Measures are Applied to Personal Information? Your privacy is important to us. Panier takes reasonable measures to protect the personal information it collects, uses, stores or discloses. We have implemented physical, technological and organizational procedures designed to protect the integrity and security, and to ensure the appropriate use, of your personal information. These procedures are appropriate to the nature, sensitivity and format of the personal information collected, used, stored or disclosed by Panier.

In order to most efficiently serve you, credit card transactions and order fulfillment are handled by established third-party banking institutions, process agents and distribution institutions. They receive the information they need to verify and authorize your credit card transactions and to ship your order. All credit card transactions are handled using secure socket layer (SSL) encryption technology. However, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. Although we make reasonable efforts to safeguard your personal information once we receive it, we cannot guarantee or warrant the security of any information you transmit to or from our Site, and you do so at your own risk. Once we receive your transmission, we will take commercially reasonable precautions to protect its security on our systems.

9. How Do You Consent To Our Use of Your Personal Information as Described in this Privacy Policy? By providing us with your personal information, you consent to our collection, use and disclosure of that information as described in this Privacy Policy as amended from time to time or as described at or before the time of collection, use or disclosure, as the case may be. If you do not want your personal information to be collected, used or disclosed in this manner, please do not submit your personal information to us or exercise opt-out procedures described above or as may be offered at the time of collection. If you have submitted personal information to us and wish to withdraw your consent to its retention, use or disclosure, please send an e-mail to info@paniergifts.com or call 877-888-8799. You may withdraw your consent, subject to legal or contractual restrictions and reasonable notice. Where permitted or required by law, Panier may collect, use or disclose your personal information without your consent, for example in response to a court order or subpoena, to comply with a legally permitted inquiry by a government agency, or to collect a debt you owe us or when we believe that such release is reasonably necessary to enforce or apply our Terms and Conditions of Use or to protect the rights, property, and safety of our Customers, others and ourselves.

10. How can you Access or Correct Your Personal Information? If you wish to access or request us to correct your personal information, please e-mail your request to Privacy Relationship Manager at info@paniergifts.com. Some information may not be accessed in certain circumstances, for example, if it contains personal information of other persons or for legal reasons.

11. Changes to this Privacy Policy. Panier reserves the right to change this Privacy Policy from time to time. If Panier Gifts makes a change, this Privacy Policy will be updated accordingly. We will inform you of any changes by posting the revised Policy on our Site. Any customer who does not agree to the revised Policy has the option to opt-out. The Policy will go into effect on the date posted. The new Policy applies to all current and past users of our Sites and replaces any prior policies that are inconsistent.
